Sony releases experimental Firefox OS ROM for Xperia E

Firefox OS has been on the horizon for a while now, and Mobile World Congress in Barcelona saw the first device partnerships announced for the fledgling mobile operating system. Though not showing any hardware in Barcelona, a press release was issued detailing Sony's plans to release a Firefox OS powered smartphone in 2014 in partnership with Telefonica.

What we have here isn't quite a Sony Firefox phone, not by any stretch of the imagination. But, what it is, is a working experimental build of Firefox OS for the Xperia E. In line with their plans to develop devices carrying the software, Sony hopes that interested developers and early adopters will take a look and garner valuable feedback.

The key thing to remember is that Sony has released this as an experimental developer ROM. It isn't meant to be a daily driver, although from the promo video we see here it looks reasonably functional, with even the camera app working properly.

We know some of you kids like playing around with new stuff -- our own editor-in-chief Phil Nickinson played with an early, early build of Firefox OS -- so if you happen to have access to an Xperia E and try this out, be sure to share your experiences with us.

Clearwire may tap financing from Sprint Nextel: WSJ

(Reuters) - Clearwire Corp plans to tap financing from Sprint Nextel , in a move that further complicates Dish Network's effort to buy Clearwire, the Wall Street Journal reported, citing people familiar with the situation.

Dish made an offer of $3.30 per share for the wireless broadband operator, which had already agreed to sell itself to majority owner Sprint for $2.97 per share. A special committee on the Clearwire board is reviewing the Dish offer.

Clearwire has the option to draw on $80 million of financing from Sprint on March 1, part of an arrangement that would gradually give Sprint a bigger stake in Clearwire.

Clearwire has already foregone the opportunity to draw $160 million in January and February. Dish has said it would withdraw its offer if Clearwire took the financing.

One of the people familiar with the situation told the Journal that Clearwire's draw of financing from Sprint Nextel was not intended to dissuade Dish from pursuing the company. (http://link.reuters.com/mun36t)

Clearwire and Sprint declined to comment to Reuters. Dish had no comment on the Journal report when contacted by Reuters.

Last week, Dish Network Chairman Charlie Ergen said the company would consider partnering with Sprint in its pursuit of Clearwire.

Markets drop, borrowing costs up after Italy's election stalemate

ROME (Reuters) - The Italian stock market fell and state borrowing costs rose on Tuesday as investors took fright at political deadlock after a stunning election that saw a comedian's protest party lead the poll and no group secure a clear majority in parliament.

"The winner is: Ingovernability" ran the headline in Rome newspaper Il Messaggero, reflecting the stalemate the country would have to confront in the next few weeks as sworn enemies would be forced to work together to form a government.

In a sign of where that might lead, former prime minister Silvio Berlusconi indicated his center-right might be open to a grand coalition with the center-left bloc of Pier Luigi Bersani, which will have a majority in the lower house thanks to a premium of seats given to the largest bloc in the chamber.

Results in the upper house, the Senate, where seats are awarded on a region-by-region basis, indicated the center-left would end up with about 119 seats, compared with 117 for the center-right. But 158 are needed for a majority to govern.

Any coalition administration that may be formed must have a working majority in both houses in order to pass legislation.

Comedian Beppe Grillo's anti-establishment 5-Star Movement won the most votes of any single party, taking 25 percent. He shows no immediate inclination to cooperate with other groups.

Despite talk of a new election, the main established parties seem likely to try to avoid that, fearing even more humiliation.

World financial markets reacted nervously to the prospect of a stalemate in the euro zone's third largest economy with memories still fresh of the crisis that took the 17-member currency bloc to the brink of collapse in 2011.

In a clear sign of worry at the top over what effect the elections could have on the economy, Prime Minister Mario Monti, whose austerity policies were repudiated by voters, called a meeting with the governor of the central bank, the economy minister and the European affairs minister for later on Tuesday.

Other governments in the euro zone sounded uneasy. Allies of German Chancellor Angela Merkel made no secret of disappointment at Monti's debacle and urged Rome to continue with economic reforms Berlin sees as vital to stabilizing the common currency.

France's Socialist finance minister also expressed "worry" at the prospect of legislative deadlock in Italy but said that Italians had rejected austerity and hoped Bersani's center-left could form a stable government to help foster growth in Europe.

    INSTABILITY

Fabio Fois, an economist at Barclays bank, said: "Political instability is likely to prevail in the near term and slow the implementation of much needed structural reforms unless a grand coalition among center-left, center-right and center is formed."

Berlusconi, a media magnate whose campaigning all but wiped out Bersani's once commanding opinion poll lead, hinted in a telephone call to a morning television show that he would be open to a deal with the center-left - but not with Monti, the technocrat summoned to replace him in a crisis 15 months ago.

"Italy must be governed," Berlusconi said, adding that he "must reflect" on a possible deal with the center-left. "Everyone must be prepared to make sacrifices," he said of the groups which now have a share of the legislature.

The Milan bourse was down more than four percent and the premium Italy pays over Germany to borrow on 10-year widened to a yield spread of 338.7 basis points, the highest since December 10.

At an auction of six-month Treasury bills, the government's borrowing costs shot up by more than two thirds. Investors demanded a yield of 1.237 percent, the highest since October and compared to just 0.730 percent in a similar sale a month ago.

Berlusconi, who was forced from office in November 2011 as borrowing costs approached levels investors feared would become unsustainable, said he was "not worried" about market reaction to the election and played down the significance of the spread.

The poor showing by Monti's centrist bloc reflected a weariness with austerity that was exploited by both Berlusconi and Grillo; only with the help of center-left allies did Bersani beat 5-Star, by just 125,000 votes, to control the lower house.

The worries immediately went beyond Italy's borders.

"What is crucial now is that a stable functioning government can be built as swiftly as possible," said German Foreign Minister Guido Westerwelle. "This is not only in the interests of Italy but in the interests of all Europe."

The euro skidded to an almost seven-week low against the dollar in Asia on fears about the euro zone's debt crisis. It fell as far as $1.3042, its lowest since January 10.

    "NON-PARTY" SURGES TO THE TOP

Commentators said all Grillo's adversaries underestimated the appeal of a grassroots movement that called itself a "non-party", particularly its allure among young Italians who find themselves without jobs and the prospect of a decent future.

The 5-star Movement's score of 25.5 percent in the lower house was just ahead of the 25.4 percent for Bersani's Democratic Party, which ran in a coalition with the leftist SEL party, and it won almost 8.7 million votes overall - more than any other single party.

"The 'non-party' has become the largest party in the country," said Massimo Giannini, commentator for Rome newspaper La Repubblica, of Grillo, who mixes fierce attacks on corruption with policies ranging from clean energy to free Internet.

Grillo's surge in the final weeks of the campaign threw the race open, with hundreds of thousands turning up at his rallies to hear him lay into targets ranging from corrupt politicians and bankers to German Chancellor Angela Merkel.

In just three years, his 5-Star Movement, heavily backed by a frustrated generation of young Italians increasingly shut out from permanent full-time jobs, has grown from a marginal group to one of the most talked about political forces in Europe.

    RECESSION

"It's a classic result. Typically Italian," said Roberta Federica, a 36-year-old office worker in Rome. "It means the country is not united. It is an expression of a country that does not work. I knew this would happen."

Italy's borrowing costs have come down in recent months, helped by the promise of European Central Bank support but the election result confirmed fears of many European countries that it would not produce a government strong enough to implement effective reforms.

A long recession and growing disillusionment with mainstream parties fed a bitter public mood that saw more than half of Italian voters back parties that rejected the austerity policies pursued by Monti with the backing of Italy's European partners.

Monti suffered a major setback. His centrist grouping won only 10.6 percent and two of his key centrist allies, Pier Ferdinando Casini and lower house speaker Gianfranco Fini, both of parliamentarians for decades, were booted out.

"It's not that surprising if you consider how much people were let down by politics in its traditional forms," Monti said.

Berlusconi's campaign, mixing sweeping tax cut pledges with relentless attacks on Monti and Merkel, echoed many of the themes pushed by Grillo and underlined the increasingly angry mood of the Italian electorate.

Even if the next government turns away from the tax hikes and spending cuts brought in by Monti, it will struggle to revive an economy that has scarcely grown in two decades.

Monti was widely credited with tightening Italy's public finances and restoring its international credibility after the scandal-plagued Berlusconi, who is currently on trial for having sex with an under-age prostitute.

But Monti struggled to pass the kind of structural reforms needed to improve competitiveness and lay the foundations for a return to economic growth, and a weak center-left government may not find it any easier.

(AP) ? The attorney for three NASCAR fans injured last weekend during a race the day before the Daytona 500 says they are exploring a possible lawsuit, but some experts say they could face tough obstacles in winning damages.

Matt Morgan, the Orlando-based lawyer for the fans, said at a news conference Tuesday than any suit would focus on the safety fence used along the track at Daytona International Speedway. He said he hopes to reach a settlement with NASCAR to avoid a lawsuit.

More than 30 people were injured last Saturday after a horrific wreck in a second-tier NASCAR series race sent chunks of debris, including a heavy tire, into the stands. Morgan declined to provide the identities of his clients, but said two of them were seated directly in front of the crash and sustained injuries ranging from a fractured fibula to abdominal swelling. All have been released from the hospital.

Some experts say there could be grounds for a lawsuit, and that courts have looked past liability waivers written on the backs of sporting event tickets. Others maintain the ticket is a legal contract that could be hard to overcome in court.

"Ultimately, I believe it would be gross negligence," Morgan said. "We all know that when you go to a race you assume a certain amount of risk. But what people don't assume is that a race car will come flying into the stands... That's why they make the fences."

Asked to comment on the fans' retention of a law firm, NASCAR spokesman David Higdon wrote in a statement, "We are unaware of any lawsuits filed."

Daytona International Speedway is owned by International Speedway Corp., a NASCAR sister company. Spokesman Andrew Booth said, "As per company policy, we do not comment on pending litigation."

Donnalynn Darling, a New York-based attorney who has been practicing personal injury law for 30 years, said there is a theory that a spectator who buys tickets to a sporting event assumes the risk of objects coming out of the field of play, such as a foul ball at a baseball game.

But she said there is also a foreseeable risk question that promoters of events also accept.

"Did the sporting event promoter take action to prevent that specific risk?" Darling asked. "In terms of this fence...it was put up to prevent people from being hurt. You have people who were not only injured by falling debris, but by the failure of the fence."

Others say such restrictive clauses on the back of tickets are generally disfavored by Florida courts.

"If it's just something written on the back of the ticket and not called to the attention of the person purchasing, there's reason to believe many courts in Florida won't hold that they consented efficiently," said University of Florida emeritus law professor Joseph Little.

Still, Paul Huck, an adjunct professor at the University of Miami School of Law, said contract law could take precedence.

"A ticket to one of these events is like a contract ? and its provisions limiting liability are generally enforceable," he said. "We enter into these types of contracts on a regular basis, and we often don't give it a second thought that we may be limiting or even giving up certain legal rights when we do so."

Darling also said that the fence's manufacturer at Daytona would likely be "very much responsible" because of it being foreseeable that debris could go through a fence that has holes in it.

That seems to be theory that Morgan is adopting. He referenced a 2009 crash at NASCAR's racetrack in Talladega, Ala. in which a car that launched into the catch fence sent debris into the stands and injured several fans.

"At that point in time a group of engineers got together and they said 'It's time for us to manufacture a safer fence,'" Morgan said. "To my knowledge, that was done. But what we have to investigate at this point in time is what was done...If you can ever point to monetary considerations being put ahead of people, then there's a big problem."

Darling predicted that NASCAR would try to settle with the injured fans.

NASCAR "had an obligation to protect the fans that are so loyal, and it is bad from a public relations standpoint," Darling said. "So they're going to do something."

PayPal cofounder Max Levchin returns to online payments with Affirm

Curious what Max Levchin's been up to ever since he left Google in 2011? Well, wonder no more. Today, PayPal's co-founder revealed his return to the payment world with a new company called Affirm. Like many startups, Affirm is looking to make online payments quicker and easier, but the real question is whether you'll be willing to come along for the ride. AllThingsD managed to catch Levchin for an interview, in which he revealed that Affirm will issue credit to consumers and guarantee payment to merchants for all online transactions. Curiously, Affirm will use Facebook to verify a user's identity, and it'll also use a wide range of social and location-based data to determine an individual's credit worthiness. The payment startup will launch in beta with 1-800-Flowers as its partner, and it's said that consumers will be given 30 days to settle the resulting bill with Affirm. There's no word of what fees or interest rates will be assessed for late payments, but we imagine you'll find strong incentive to pay for that flower arrangement.

The brutal, exaggerated death of the form factor phone

The brutal, exaggerated death of the form factor phone

This year's Mobile World Congress is bound to be frenetic with phone news. That's why we're about to brave Barcelona's rain, airline strikes and pickpockets (no offense, dear BCN) in order to stay up-to-date. But if there's one aspect of mobile phones we're not counting on to provide much excitement, it's their fundamental physical design or form factor. We're in the grip of the monolith, the concrete slab, the plain rectangle, with its full touchscreen and a couple of buttons here and there, and that grip is so tight that even the pickpockets are slightly shocked when they haul in something with a physical QWERTY.

But the point of this piece isn't merely to plot the decline of form factor diversity. It's actually to argue that the current monotony is probably only temporary, and that signs of a revival are already in the air. Read on and we'll do our utmost to convince you.

The defense and prosecution both completed their arguments with the magistrate soon to rule if the double-amputee athlete can be freed before trial or if he must stay behind bars pending trial. (AP Photo)

JOHANNESBURG (AP) ? Oscar Pistorius reported to South African authorities on Monday under bail terms in the murder case against him, said a spokeswoman for the Olympic athlete.

The double-amputee runner visited correctional officers in the capital, Pretoria, said Lunice Johnston.

"Oscar did present himself to the necessary authorities this morning," Johnston told The Associated Press.

Pistorius, who was released on bail Friday, is staying at the home of his uncle, Arnold, in the affluent suburb of Waterkloof in Pretoria.

Pistorius is accused of murder in the shooting death of his girlfriend, Reeva Steenkamp, in the early hours of Feb. 14. Prosecutors say the pair had an argument before Steenkamp was killed; Pistorius says he mistook her for an intruder and shot her accidentally.

Chief Magistrate Desmond Nair had set bail at 1 million rand ($113,000). The 26-year-old track star was also ordered to hand over his passports, turn in any guns he owns and keep away from his upscale home in a gated community in Pretoria, which is now a crime scene.

He cannot leave the district of Pretoria without his probation officer's permission and is not allowed to consume drugs or alcohol, the magistrate said.

Pistorius' longtime coach, Ampie Louw, had said when the runner was in detention that he wanted to put him back into training in the event that he was granted bail.

Johnston, however, said she knew of no immediate plans for him to return to the track.

Pistorius' next court appearance is on June 4. Pistorius faces life imprisonment if convicted.

Horse meat in US? Unlikely, but tests are rare

    Leonhard Foeger / Reuters

An employee of the microbiological laboratory of the Austrian Agency for Health and Food Safety prepares a sample of minced meat in Vienna this week. The samples of minced meat are tested for the presence of horse meat as a precaution. United States officials say it's highly unlikely the scandal will reach U.S. consumers.

By JoNel Aleccia, Staff Writer, NBC News

Europe?s scandal over horse meat hidden in beef products -- including recalls of Nestle ravioli and Birds Eye chili con carne -- has renewed questions about whether Americans unwittingly could be eating equine products as well.

U.S. Department of Agriculture regulators say it?s highly unlikely that beef adulterated with horse meat could make it to the nation?s dinner plates because no domestic suppliers currently slaughter horses and the agency has strict labeling and inspection standards for imported meat.

But agency officials also acknowledge privately that species testing for meat imported into the U.S. is performed typically only when there?s a reason to question a shipment.

And a Florida company that supplies the only validated tests for horse meat in food has been slammed with nearly 1,000 requests in recent weeks for its $500 kits -- including orders from major U.S. meat producers.

?It?s becoming a little hectic,? said Natalie Rosskopf, administrative director of Elisa Technologies Inc. of Gainesville. ?There was no call for horse testing a month ago. Nothing.?

Continental Europe has been roiled recently by reports of horse meat masquerading as beef in frozen burgers and prepared foods, including frozen dinners and pastas. This week, Nestle announced it was removing chilled pasta products produced by a German supplier, including Buitoni Beef Ravioli and Beef Tortellini, from stores in Italy and Spain, and a lasagna product from France. On Friday, frozen food maker Birds Eye said it would withdraw products including chili con carne from Britain and Ireland because tests detected traces of horse DNA.

The trouble with horse meat hidden in beef is partly a health concern. Meats taken from store shelves in Britain and Germany had traces of a powerful equine painkiller, phenylbutazone, or ?bute,? which is banned in animals destined for human food, tests showed.

But it?s also about trust, especially in the U.S., where many shudder at the mere thought of eating horse meat and the deception would raise even more suspicion about a company?s practices.

?If a company is willing to commit fraud, I can?t imagine that food safety is the biggest thing on their agenda,? said Bill Marler, a Seattle lawyer and food safety expert who publishes a blog focused on the industry.

In fact, boneless beef adulterated with horse meat -- and with kangaroo -- did make it to the U.S. more than 30 years ago, when mislabeled meat from Australia led to the impounding and testing of 66 million pounds of the product, according to old USDA records found and posted by Marler.

Known as the ?Australian meat incident,? the beef substitution scandal prompted swift action and increased scrutiny by agency officials.

USDA officials couldn?t quickly produce records of species testing results in the past 30 years -- or even the past year -- but they say the possibility of that happening again is remote. The U.S. neither slaughters horses nor imports horse meat from other countries, and it doesn?t allow import of beef from the countries and companies involved in the European scandal, an official told NBC News. (He was speaking on background because he said he wasn?t authorized to discuss the issue.)

In addition, USDA inspectors look at every shipment of meat sent through U.S. ports and can demand species testing if anything is amiss, documents show.

Officials with the Food and Drug Administration, which oversees processed foods, said that they had detected no horse meat in imported or U.S.-made food.?

?We have no past record or current indication that horse meat is an ingredient in any FDA-regulated processed foods in the U.S.,? Jalil Isa, an FDA spokesman, said in an email. He added that FDA officials are reaching out to Nestle and Birds Eye to ensure that no adulterated food was sent to the U.S. Nestle has said no U.S. products use meat from European sources.

Birds Eye Iglo U.K. products have no connection to the Birds Eye brand in the U.S., which is owned by Pinnacle Foods, and isn?t affiliated with the U.K. supplier.

Producers such as the meat giant Cargill say they don?t import beef from plants that also slaughter horses, or from the companies and suppliers implicated in the European scandal, and they remain confident that their meat is free of adulteration.

?Cargill?s beef supply chain is shorter than those involved in the horse meat issue in Europe and we know, and work directly with, our suppliers, which minimizes the potential for fraudulent substitution of products,? Cargill spokesman Mike Martin told NBC News in an email.

Still, the problems in Europe could prompt renewed scrutiny, he added.

?We do not analyze for other species and are assessing the current situation to determine if this is something we might do in the future,? Martin said.

If they do, they?ll have to turn to Elisa Technologies for the horse species test, said Rosskopf. The company?s meat species kits, which verify animal proteins in raw and cooked meat samples, have been used for years by the USDA and by private firms, she said.

Before the discovery in Europe of horse meat in beef, the firm?s typical demand was for tests for more common species, for instance, to confirm that no pork was present in kosher meat, Rosskopf said. Now, meat suppliers mostly in Europe, but also in the U.S., have been clamoring for the equine test.

Have there been any positive tests so far?

?I can?t say,? said Rosskopf, noting that the company is known for its adherence to confidentiality agreements.

Of course, putting horse meat on the dinner table is common in many countries, including France, Canada, Mexico and Japan, to name a few. And it?s not unheard of on American menus, either. Slaughterhouses that produced horse meat for human consumption were in operation in the U.S. until 2007, when the last three of a one-time high of 16 or 17 plants closed under state and federal pressure.

Congress effectively banned the practice then by refusing to fund USDA inspections of the slaughterhouses. Those efforts were fueled by vocal anti-slaughter activists who regarded the practice as inhumane.

The arrangement stayed in place until 2011, when the Obama administration quietly lifted the restriction, partly out of concern for the neglect of horses in the U.S. and the treatment of horses that were shipped to Canada and Mexico to be killed.

The U.S. exported more than 46,000 metric tons of horse meat in 1990, a figure that fell to about 5,600 metric tons in 2007, when the ban was enacted, industry figures show.

Wyoming state Rep. Sue Wallis is trying to reinstate horse slaughter in the U.S. and to build a new source for the meat in America and abroad.

Her application is among those pending with the USDA to open horse slaughterhouses in Missouri, Iowa and New Mexico. The firms would produce what she and other advocates call ?cheval,? horse meat that she said is prized by gourmet cooks and health enthusiasts for its taste and lean profile. Plus, Wallis said, horse meat is generally about 40 percent cheaper than beef.

?There are plenty of people in America who have no problem with cheval and are anxiously awaiting our product,? she said.

Falcon Pro reaches Twitter?s 100k token limit

Falcon Pro, arguably one of the best Twitter clients available for the Android operating system, has just reached its 100,000 token limit set by Twitter. The limit was set by Twitter back in August of last year, and it limits 3rd party apps, who utilize Twitter?s main features, to only 100,000 users. Falcon Pro has hit this limit only 3 months after it launched its app, catching them by surprise.

Falcon Pro reaches Twitter's 100k token limit

As of right now, Falcon Pro has created a petition. The creators hope that the petition will get enough signatures to convince Twitter to extend Falcon Pro?s amount of tokens. As of 8 hours ago, the petition has accumulated over 600+ signatures. Whether this helps or not is completely up to Twitter. Falcon Pro is also working on the issue of pirates. According to its stats, only 40,000 people have actually purchased its app, meaning there are 60,000 who either aren?t using the client anymore, or have pirated the app.

    ?

Falcon Pro is also asking users who don?t use its client anymore to revoke access to the app via their Twitter settings. This way there can be additional tokens freed up for other users. Falcon Pro has included a disclaimer in its app description warning users of the 100k limit. Hopefully it will stop users from giving the app a 1-star rating. However, it still has to deal with the refunds for people who bought the app, but can?t access it.

Falcon Pro is currently finding other ways to get an extension on its tokens, and it?s trying to avoid any methods that may breach Twitter?s terms of service. While it?s important to get more users access to its app, Falcon Pro doesn?t want to jeopardize anything for its current users. So as of right now, all its users can do is sign its petition and hope that Twitter?s lenient.

Kate Hudson, Matt Bellamy Vacation In Miami With Their Kids (PHOTOS)

After celebrating the Brit Awards in London on Wednesday, Kate Hudson and Muse frontman Matt Bellamy headed to Miami, Fla., with their family on Friday for the U.S. leg of Bellamy's tour.

The engaged couple, who have been together since 2010, hit the beach with their 1-year-old son Bingham and Hudson's son with ex-husband Chris Robinson, Ryder, 9, on Feb. 22, enjoying the warm weather as they splashed in the water along the shore.

Hudson, 33, was also seen playing some foosball with Ryder at their hotel pool before heading back to the beach to meet up with Bellamy, 34, and Bing.

As for their wedding plans, Hudson and Bellamy have stayed mum on the subject, but they're definitely looking forward to tying the knot eventually.

?We?re sort of going back and forth about, you know, is it a big wedding? Are we going to get married on a mountaintop? You know we?ve both been so into having a baby and our life schedules," Hudson told Ellen DeGeneres in September. "We just want to make sure it?s right when it happens.?

Steven Tyler on cocaine: 'I snorted half of Peru'

    By Us Weekly

Chris Weeks / Getty Images file

Steven Tyler talks about his use of cocaine in a new interview with Australia's "60 Minutes."

Steven Tyler has spent more money on drugs than most people will make in their lifetimes. The Aerosmith frontman, 65, recently opened up about his past cocaine use in an interview with Australia's "60 Minutes" -- and it's nothing short of shocking.

Asked whether it was true that -- as written in his 2011 memoir, "Does the Noise in My Head Bother You?" -- he spent some $20 million on blow in the 1970s and '80s, the rocker said no. But the real number wasn't that far off.?

Photos from ?Us: Famous bad boys

"Probably, realistically, 5 or 6 (million), easy," he revealed. "But it doesn't matter. You could also say I snorted half of Peru, but, you know, it's what we did."

Indeed, Tyler has spoken candidly in recent years about his history with drugs. In 2011, he revealed to "Dateline" that during Aerosmith's heyday in the 1970s and '80s, the band's tour rider included a small off-stage cubby where they could tend to their coke habit.?

    Photos from Us: Celebrity meltdowns

"I needed blow," he told Matt Lauer. "I needed that cocaine. I needed it." That need nearly ruined him, he added. "It took my children away, it took my marriages away. I was on my knees."

Tyler got sober in the mid-'80s, but he later relapsed. In 2006, he became addicted to prescription medication while being treated for hepatitis C. That led him back into old habits, and in December 2009 -- after a Thanksgiving binge on cocaine and pills -- he checked himself into the Betty Ford Clinic.

Photos from Us: Celebrity rehab centers

A short time later, the musician found a new way to get his thrills: by taking a job as a judge on "American Idol," serving on the Fox series for seasons 10 and 11 in 2011 and 2012. Last year, he told Time magazine that he took the job because he needed something risky in his life. "I'm one of those people that -- obviously, since I've wound up in rehab eight times -- take dangerous things and jump in with both feet," he said. "I think I'm addicted to adrenaline."?

Facebook's plan for West Campus to be reviewed Monday by Menlo Park planners

Facebook's plan to build a second campus on the west side of Bayfront Expressway moves to the Menlo Park Planning Commission on Monday.

The social network company has asked the city to rezone its 22-acre West Campus site because the building height there is now limited to 35 feet.

The 43,555-square-foot office and rooftop park that Facebook wants to build above a surface-level parking lot would reach a height of 73 feet, according to city documents. The building has been designed by celebrated architect Frank Gehry.

The commission also will consider approving an official statement that the development's benefits would outweigh its negative environmental impacts. According to a city memo, one significant and unavoidable impact could be additional traffic at the intersections of Marsh and Middlefield roads and University Avenue and Donohoe Street. Construction noise is another potential impact.

In addition, the commission is to consider allowing removal of 175 heritage trees and approving Facebook's agreement to provide either $4.5 million in fees to the city for affordable housing or put up 15 affordable housing units elsewhere, or a combination of both.

In January, the city council approved a development agreement for the West Campus project that calls for Facebook to pay Menlo Park $1.5 million over 10 years and $100,000 for local improvements, and to restrict the number of vehicles entering and leaving the new campus. Facebook

also has committed to pay the city at least $194,000 a year in property taxes.

The West Campus, previously occupied by Tyco Electronics at 312 and 313 Constitution Drive, would be given the new address of 1 Facebook Way. About 2,900 employees will work there, according to project documents.

The new building will be linked to the main campus -- the former headquarters of Sun Microsystems -- via a tunnel underneath Bayfront Expressway. The main campus has been permitted to accommodate as many as 6,600 employees.

The planning commission will meet in the council chambers, 701 Laurel St., at 7 p.m.

Gun-control bills pass Colorado House: Was Aurora a tipping point?

The Colorado House passed four gun-control measures Monday, a notable shift for a typically libertarian, pro-gun state. Has the political climate changed enough for bills to pass state Senate?

    By Amanda Paulson,?Staff writer / February 20, 2013

Democrat Rep. Rhonda Fields speaks before the Colorado House Monday as they consider a bill she sponsored that prohibits large capacity ammunition magazines. Colorado House Democrats passed four gun-control bills responding to recent mass shootings.

It?s hard to imagine a state that better symbolizes America?s conflicting relationship with guns and gun control than Colorado.

A Western state with a strong libertarian streak, it boasts a large number of gun enthusiasts and hunters, and many residents have a knee-jerk reaction against government infringement of individual liberties.

It?s also been host to two of the worst gun massacres in recent years ?? at Columbine High School and the Aurora movie theater. And, as of the most recent election, has a state government entirely controlled by Democrats.

Now, Colorado is on its way to enacting a package of gun-control bills that would make the state significantly tougher than any of its Western neighbors.?As lawmakers in a number of other states introduce bills trying to preemptively exempt their state from any possible future federal gun restrictions, it?s notable that Colorado is going the other direction. And the mass shootings are a primary driver.?

On Monday, the Colorado House of Representatives passed four bills that would place some limits on gun ownership: ammunition magazines limited to 15 rounds; a requirement for background checks for all gun transactions; a requirement that gun purchasers pay for their own background checks; and a ban on concealed guns in stadiums and on college campuses.

"Enough is enough. I'm sick and tired of bloodshed," said Democratic Rep. Rhonda Fields, a sponsor of both the magazine-capacity bill and the universal background check bill. Representative Fields is from the district where the Aurora shooting took place, and her son was killed in a 2005 shooting.

Debate on the House floor was heated, and several Democrats sided with Republicans (all of whom voted against the bills).

Now, the bills move on to the state Senate?, which is also controlled by Democrats, albeit by a slimmer margin.

?These are draconian controls and not things we?re feeling happy about,? says Dudley Brown, executive director of Rocky Mountain Gun Owners.

Mr. Brown says he holds out some hope that the Senate may block at least one of the bills, but either way, his organization?plans to target everyone who votes for them in marginal districts in the 2014 elections.

Ford urges U.S. pressure on Japan ahead of meeting

Ford urges U.S. pressure on Japan ahead of meeting
    Automotive News
    February 21, 2013
    by Craig Trudell

CLEVELAND (Bloomberg) -- Ford Motor Co. pushed for President Barack Obama to pressure Japan's prime minister to open its auto market and refrain from weakening the yen to give its companies an advantage.

Less than 4 percent of auto sales in Japan last year were brands from companies based outside the country, Joe Hinrichs, Ford's president of the Americas, said today at an Ohio engine plant.

Ford also is concerned about the yen, which has weakened about 8 percent against the dollar since Dec. 26, when Shinzo Abe became prime minister.

"We hope the U.S. government will send a clear message that any future trade policy with Japan must ensure a level playing field and not come at the expense of American workers," Hinrichs told workers at the factory. Ford plans to invest about $200 million and add 450 new jobs there by late 2014.

Ford is boosting production in Asia, with an emphasis in China, where it will spend more than $4.9 billion to introduce 15 new models by 2015 in an effort to compete in the region with General Motors Co. and Volkswagen AG. Ford sells "a few hundred vehicles a month" in Japan, Hinrichs told reporters today.

The yen has weakened more than any currency since mid-November and trades at about 93 to the dollar. Japan's Abe, 58, and Obama, 51, meet tomorrow and will seek to bolster their alliance as a bulwark against China's territorial claims and North Korea's nuclear ambitions.

NASA's Kepler mission discovers tiny planet system: Smallest planet yet found around a star similar to our sun

Feb. 20, 2013 ? NASA's Kepler mission scientists have discovered a new planetary system that is home to the smallest planet yet found around a star similar to our sun.

The planets are located in a system called Kepler-37, about 210 light-years from Earth in the constellation Lyra. The smallest planet, Kepler-37b, is slightly larger than our moon, measuring about one-third the size of Earth. It is smaller than Mercury, which made its detection a challenge.

The moon-size planet and its two companion planets were found by scientists with NASA's Kepler mission, which is designed to find Earth-sized planets in or near the "habitable zone," the region in a planetary system where liquid water might exist on the surface of an orbiting planet. However, while the star in Kepler-37 may be similar to our sun, the system appears quite unlike the solar system in which we live.

Astronomers think Kepler-37b does not have an atmosphere and cannot support life as we know it. The tiny planet almost certainly is rocky in composition. Kepler-37c, the closer neighboring planet, is slightly smaller than Venus, measuring almost three-quarters the size of Earth. Kepler-37d, the farther planet, is twice the size of Earth.

The first exoplanets found to orbit a normal star were giants. As technologies have advanced, smaller and smaller planets have been found, and Kepler has shown that even Earth-size exoplanets are common.

"Even Kepler can only detect such a tiny world around the brightest stars it observes," said Jack Lissauer, a planetary scientist at NASA's Ames Research Center in Moffett Field, Calif. "The fact we've discovered tiny Kepler-37b suggests such little planets are common, and more planetary wonders await as we continue to gather and analyze additional data."

Kepler-37's host star belongs to the same class as our sun, although it is slightly cooler and smaller. All three planets orbit the star at less than the distance Mercury is to the sun, suggesting they are very hot, inhospitable worlds. Kepler-37b orbits every 13 days at less than one-third Mercury's distance from the sun. The estimated surface temperature of this smoldering planet, at more than 800 degrees Fahrenheit (700 degrees Kelvin), would be hot enough to melt the zinc in a penny. Kepler-37c and Kepler-37d, orbit every 21 days and 40 days, respectively.

"We uncovered a planet smaller than any in our solar system orbiting one of the few stars that is both bright and quiet, where signal detection was possible," said Thomas Barclay, Kepler scientist at the Bay Area Environmental Research Institute in Sonoma, Calif., and lead author of the new study published in the journal Nature. "This discovery shows close-in planets can be smaller, as well as much larger, than planets orbiting our sun."

The research team used data from NASA's Kepler space telescope, which simultaneously and continuously measures the brightness of more than 150,000 stars every 30 minutes. When a planet candidate transits, or passes, in front of the star from the spacecraft's vantage point, a percentage of light from the star is blocked. This causes a dip in the brightness of the starlight that reveals the transiting planet's size relative to its star.

The size of the star must be known in order to measure the planet's size accurately. To learn more about the properties of the star Kepler-37, scientists examined sound waves generated by the boiling motion beneath the surface of the star. They probed the interior structure of Kepler-37's star just as geologists use seismic waves generated by earthquakes to probe the interior structure of Earth. The science is called asteroseismology.

The sound waves travel into the star and bring information back up to the surface. The waves cause oscillations that Kepler observes as a rapid flickering of the star's brightness. Like bells in a steeple, small stars ring at high tones while larger stars boom in lower tones. The barely discernible, high-frequency oscillations in the brightness of small stars are the most difficult to measure. This is why most objects previously subjected to asteroseismic analysis are larger than the sun.

With the very high precision of the Kepler instrument, astronomers have reached a new milestone. The star Kepler-37, with a radius just three-quarters of the sun, now is the smallest bell in the asteroseismology steeple. The radius of the star is known to three percent accuracy, which translates to exceptional accuracy in the planet's size.

    Florida governor expands Medicaid

By Maggie Fox, Senior Writer, NBC News

Florida governor Rick Scott, one of the biggest critics of President Obama?s health reform efforts, said Wednesday he would do the administration?s bidding and expand the Medicaid program.

But Scott said he was doing the expansion on his own terms: for three years only, while the federal government is footing the entire bill.

?While the federal government is committed to paying 100 percent of the cost of new people in Medicaid, I cannot, in good conscience, deny the uninsured access to care,? Scott said in a news conference.

?We will support a three-year expansion of our Medicaid program under the new health care law, as long as the federal government meets their commitment to pay 100 percent of the cost during this time. This legislation would sunset after three years and need to be reauthorized.?

Scott denied he was giving in to the administration. ?It is not a white flag of surrender to government-run health care,? he said.

The 2010 Affordable Care Act was designed to transform health care in the United States, which most experts agree currently costs too much and leaves far too many people without health insurance.?It was meant to provide more care to people who can?t buy insurance by forcing states to expand Medicaid.

The hope was to add about 16 million of the poorest people to the rolls -- about half of those who need health insurance. But after a series of challenges to the law, the U.S. Supreme Court ruled in June that the Medicaid expansion requirement went too far. While most of the Affordable Care Act was constitutional, the court ruled, the federal government could not force states to offer Medicaid to more people.

The Congressional Budget Office projects that 12 million people will become newly eligible for Medicaid in the states that choose to expand their offerings by 2022.?The law required states to extend Medicaid to people earning up to 133 percent of the federal poverty level, or about $14,800 for single people and $31,000 for a family of four.

Many Republican governors immediately said they wouldn?t expand Medicaid.

Texas governor Rick Perry turned down $76 billion in federal matching funds that would have helped pay to do it over the first five years. ?We?re just not going to be a part of ? socializing health care in the state of Texas,? Perry told reporters in July.

South Carolina?s Nikki Haley said expanding Medicaid would bring people out who were already qualified -- and she said that her state would go broke taking care of them, even if the federal government paid the bill for those who would newly qualify. In addition, states will have to start paying a very small percentage in 2017.

But health care experts predicted that many red states would not turn away free money from the federal government.

Arizona governor Jan Brewer said her state would expand Medicaid to about 300,000 residents in her state of the state address last month. Michigan governor Rick Snyder made his announcement Feb. 6: His state will add about 320,000 people to the joint state-federal health insurance plan for the low-income.

?I am forced to accept it as today?s reality and I have decided to expand Nevada?s Medicaid coverage,? Nevada governor Brian Sandoval, another Republican, ?said in December.

Republican-leaning holdouts include Alabama, Louisiana, Idaho, Mississippi, South Carolina, Maine and 12 others.

Scott said he wasn?t happy, but said he was facing reality.

?There are no perfect options. Our options are either having Floridians pay to fund this program in other states while denying health care to our citizens or using federal funding to help some of the poorest in our state with the Medicaid program as we explore other health care reforms,? he said.

    Left-leaning groups applauded.

?Now about 613,000 Florida women stand to gain the security of quality health coverage and the ability to get the care they need, when they need it, without facing huge medical bills,? said Judy Waxman of the National Women?s Law Center.

?Combined with other reforms in the Affordable Care Act, this expansion would reduce the percentage of uninsured women in Florida from 25.3 percent to 5.8 percent.?

Scott says he?s not against health reform, he just doesn?t like the approach taken in the 2010 health reform law.

?Before I ever dreamed of standing here today as Governor of this great state, I was a strong advocate for better ways to improve health care than the government-run approach taken in the President?s health care law,? he added.

?I believe in a different approach. But, regardless of what I -- or anyone else -- believes, a Supreme Court decision and a presidential election made the President?s health care mandates the law of the land.?

Scott says he will still refuse to set up a state health insurance exchange, leaving the federal government to run it.
